COVID-19 Status Update

March 17, 2020

Terrier Claims Services continues to provide our clients with the highest quality service and response to your needs during the COVID-19 outbreak.

We acknowledge the situation is extremely fluid and can change day to day and even hour to hour regarding closings and transportation.

We have implemented precautions to minimize health risks to our clients and staff.

We have given instruction to our investigators to avoid hospitals and emergency rooms in an attempt to minimize any exposure to COVID-19 or other cold and flu viruses. If they are experiencing ANY symptoms, they should alert the office that they are unable to work, and they will stay home until they are better. If testing is called for, they will avail themselves of the same and follow all guidelines.

We have also advised our investigators that if subjects refuse to be seen/interviewed face to face, to take the statement over the phone to collect the needed information. A written statement can be transcribed, signed, and notarized subsequently if required.

Adjusters are available to handle property claims.  Should an inspection not be possible, we are available to perform an in-depth comprehensive desk adjustment in conjunction with the use of conferencing technology.

Our office staff has the full capability to work from home if necessary. Intake and assignment of cases will be seamless as will sending reports and documents.

We have minimized meetings and presentations for the well-being of everyone.  Be assured, we are willing to discuss any issue or request at any time while following health guidelines.

We welcome any suggestions you may have. Please let us know if any of your operations may be suspended in the short term.

In this unprecedented health crisis, please be assured that we will diligently provide you with the same high-quality service you have come to expect from Terrier Claims Services

Best Regards,

Dan Sullivan

The Bodily Injury Plaintiff’s Background – Obtaining and Admitting the Evidence from Inception through Trial – CLE

Terrier Claims Services Mark Wilhelmsson and Jason Gudaitis along with other speakers recently participated in a continuing legal education seminar offered by The Defense Association Of New York(DANY) in New York City to discuss the aspects of a plaintiff’s background worth investigating, techniques and resources for investigating a plaintiff’s background; using depositions and other devices to obtain information, to establish foundations for discovery, and to authenticate investigation work product, the interplay of background investigation and trial preparation and using a plaintiff’s background at trial.

Background searches including DMV, National Profile, Litigation, Criminal Records, ISO Claim Search Casualty System, and Social Media searches provide information about the bodily injury plaintiff’s background.  Each of these searches provides a unique view of the history of the plaintiff and social media can provide up to date information regarding the plaintiff’s past and present activities.  Background searches should be performed prior to the issuance of the ISO Claim Search subpoena so that all relevant data can be noted on the subpoena itself including various spellings of the plaintiff’s name and aliases.  The plaintiff’s history background insures that all necessary authorization requests can be submitted and updated litigation searches can be performed with respect to the information returned.   Having the complete package prior to the deposition opens the opportunity to ask the questions that significantly impact the case.
